In response to the recently revived thread about e-reserves and
copyright, some random thoughts:

It's inadvisable, if not impossible, to reduce copyright concerns to
simple formulations. Copyright and Fair Use are complex, and Reserves
materials and uses are all over the map. So although I agree that
there is a place for Fair Use in electronic reserves systems, I also
think there is a place for seeking permissions. In my humble and
non-lawerly opinion, it depends on the materials and the uses involved.

Secondly, I believe that all libraries and librarians benefit from
there being a range of interpretations on these issues. Tolerance for
diverse viewpoints leads to a healthy exchange of ideas and a fertile
environment for experimentation. That's what we've seen, and that has
allowed the establishment, acceptance and growth of e-reserves services.
No small feat, considering the increasing treatment of the most
obscure and esoteric bits of information as marketable commodities.

Any combination of solutions that leads to timely, affordable
processing of and access to course-related materials serves us
well. Therefore initiatives from the CCC that streamline the
permissions process should be encouraged alongside of efforts to
promote Fair Use in e-reserves. We need to collaborate on making
e-reserves uses standard in licensing agreements for e-books and
journals. All of these aims can and should be pursued
simultaneously.

Let's be encouraging and educational, not discouraging or disparaging
to our e-reserves peers- even if they take a different local view of
some of the issues.
