I am resending this e-mail to you because Burns' staffer, Brett Scott
told me this afternoon that the Telecommunications Conferees did not
yet get to Section 304. In fact they won't get to it until at least
Friday, December 15. SO, THERE IS STILL TIME TO CONTACT THESE KEY
PEOPLE. It sounds as if the major roadblocks are Bliley, Fields,
Dingell, Hyde, and Conyers. Any additional pressure you can put on
them in particular would be terrific. Brett also indicated that the
Conference is not going well and that the Conferees might even decide
to ignore the agreed-upon staff recommendations.
PLEASE KEEP UP THE PRESSURE!!!

Late Monday afternoon, I spoke with Brett Scott, Senator Burns'
telecommunications staff person. He told me that the Members of the Telecom
Conference Committee will meet Tuesday at 2pm to vote on "Member
Issues"--those which have not been resolved by telecommunications staff.
Section 304(b) of the Senate telecommunications bill (S. 652) (sometimes
known as the "Inquiry" provision), offered by Senators Burns (R-MT) and
Kerrey (D-NE), provides an essential mechanism to ensure that advanced
telecommunications capability and distance learning are deployed to
elementary and secondary schools and classrooms in a timely fashion.
Translated--this means that after 2 years or so a study will be done to
determine whether advanced services are actually being deployed to schools
and classrooms. If they are NOT and state regulations are frustrating this
deployment, the FCC can PREEMPT those state laws or regulations that are
preventing timely deployment.
This preemption clause is crucial because it puts teeth in a provision that
will provide broadband connections to schools. Broadband connections will
vastly improve the capabilities of distance learning. Broadband will enable
the instantaneous transfer of complicated graphics (which either cannot be
transmitted or are extraordinarily slow in their transmission over narrowband
connections). It will enable students at distant sites to work on projects
together over their computers. The possibilities are endless. But the House
is very resistant to this provision--professing that it is designed to line
the pockets of the Corning Corporation which makes fiber. Senator Burns'
position is that we don't care how the broadband connections are made (fiber,
coaxial, satellite), we just need access to them. House Conferees are also
concerned about the state preemption clause, but that's what makes the
provision so invaluable. Senator Kerrey's staff person, Carol Ann Bischoff,
brought this issue to our attention last week and continues to work hard to
retain Section 304(b) . Because of the work of Senators Burns and Kerrey,
Senate Members seem solidly behind this provision, however the House needs a
MAJOR influx of calls, faxes and e-mails in support of keeping Section 304(b)
in the final bill.
