STRUCTURE OF EACH ENTRY

Contract Element

A term or element contained in most electronic product contracts (for example, "Defining the Product or Service," "Defining the User," etc.). Each term (or contract element) outlined in the table of contents may not be employed in every agreement for networked information (or it may be identified differently). Those who participated in this research believe that the content (or primary issues included in most contracts for networked information) are identified in this guide.

Definition

A neutral statement which attempts to clarify and contextualize each contract element.

Discussion

Discussion of positions, strategies, financial implications, access issues, and applications (among other things) which characterize each contract element.

Benefits

Describes benefits to either (or both) parties that are associated with each contract element.

Risks

Identifies potential risks to either (or both) parties that are associated with each contract element.
